Entrance for the Giveaway begins at 12:01 AM Pacific Daylight Time (“PDT”) the first day of the announcement and continues until the Winner is announced on the selected day which is updated periodically and listed here http://www.trysouthflorida.com/giveaway-information/. (“Giveaway Period”).
1. ELIGIBILITY
This 3-Day South Florida Vacation Giveaway (the “Giveaway”) is open only to legal residents of the fifty (50) United States and the District of Columbia (except those residing in Rhode Island, Idaho, Nebraska, New Jersey and West Virginia), who are at least eighteen (18) years old at the time of entry.
Employees of Sponsor (as defined below) and other companies associated with the promotion of the Giveaway, and their respective parents, subsidiaries, affiliates and advertising and promotion agencies, as well as the immediate family (spouse, parents, siblings, and children) and other household members of each such employee, are not eligible.
2. Sponsor
The Giveaway is Sponsored by ImagineQuest Info Products, Inc, a Florida Corporation d/b/a Try South Florida (“Sponsor”), located at 4613 N. University Drive #186, Coral Springs, FL 33067.
3. AGREEMENT TO OFFICIAL RULES
Entry in the Giveaway constitutes Entrant’s full and unconditional agreement to and acceptance of these Official Rules and the decisions of the Sponsor, which are final and binding. Winning a Prize is contingent upon being compliant with these Official Rules and fulfilling all other requirements set forth herein and/or required by applicable law.
Sponsor reserves the right to verify the eligibility of Winner. Any entry shall be rendered void if in contravention of these Giveaway Rules (“the Official Rules”) or where prohibited or restricted by law.
4. GIVEAWAY PERIOD
Other than previously mentioned statements about the Giveaway Period, entries that are submitted before or after the Giveaway Period will be disqualified. Submissions will be accepted for the duration of the Giveaway Period.
5. HOW TO ENTER
a. You may enter the Giveaway in either of the following ways:

By entering the Giveaway online, you understand that you will be automatically subscribed to our mailing list, and may receive communications from us from time to time in the future, and you expressly consent to agree to such subscription and communications.
Alternate Method of Entry – By Mail: You may also enter by filling out a standard postcard, postage prepaid, setting forth [the words 3-Day South Florida Vacation Giveaway Entry”, your first and last name, address, city, state, zip code, e-mail address, year and date of birth], and mailing it to [4613 N. University Drive #186, Coral Springs, FL 33067, Attn: Michael Holland]. If you enter through this alternative method of entry, you will not be subscribed to our mailing list.
b. Limit one (1) submitted entry per person for the duration of the Giveaway Period, regardless of method of submission. Entries received in excess of the stated limitation will be void.
However, for each friend you persuade to enter the Giveaway, and to designate you as a referrer, you will receive 10 additional “entries” or chance(s) to win. All entries become the property of the Sponsor and will not be acknowledged or returned.
In the event of a dispute regarding an entry, entries will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the e-mail address by an internet access provider or other organization that is responsible for assigning e-mail addresses or the domain associated with the submitted e-mail address.
6. PRIZE DRAWING; ODDS OF WINNING
On or about the drawing time and date as shown on our web site http://www.trysouthflorida.com/giveaway-information/, the Sponsor will select the potential Winner(s) in a random drawing, without replacement, from among all eligible entries received. The odds of being selected depend on the total number of eligible entries.
Any Entrant who has won a previous Prize drawing will be excluded. Entrants do not need to be present to win.
7. WINNER NOTIFICATION
The potential Winner(s) will be notified by email. The Sponsor will attempt to notify each potential Winner three (3) times following the drawing via email and/or by Facebook message. If any potential Winner cannot be contacted within three (3) business days after the date of the first attempt to contact him/her, or is disqualified for any reason, or refuses or fails to comply with the Acceptance Criteria detailed below, the Sponsor may select an alternate potential Winner in his/her place at random from the remaining non-winning, eligible entries.
Each Winner will also be required to complete, sign and submit a Declaration of Compliance, in form as provided by Sponsor, within fourteen (14) business days of the date notice or attempted notice is first sent, in order to claim his/her Prize. If a potential Winner cannot be contacted, or fails to submit the Declaration of Compliance within the required time period, that potential Winner forfeits the Prize.
If the potential Winner is at least eighteen (18) but still considered a minor in his/her jurisdiction of residence, Sponsor reserves the right to award the Prize in the name of his/her parent or legal guardian, who will be required to sign the Declaration of Compliance on the potential Winner’s behalf and fulfill any other requirements imposed on the Winner as set forth herein.
Potential Winners must continue to comply with all terms and conditions of these Official Rules and with applicable laws, and winning is contingent upon fulfilling all such requirements. Sponsor will take reasonable steps to ensure that all Prizes are fulfilled within approximately thirty (30) calendar days after the conclusion of the Giveaway (the “Award Period”).
8. ACCEPTANCE CRITERIA
Potential Winner must consent to each of the following Acceptance Criteria to be considered an official Winner:
a. Provide a current photograph of themselves via e-mail in the jpeg format;
b. Sign a Declaration of Compliance (where permitted by law) within fourteen (14) days of notification; and
c. Provide feedback upon request by Sponsor on their resort experience.
9. THE PRIZE
a. Vacation Prize: One (1) Entrant will receive three (3) free consecutive nights at a hotel in South Florida. Winner must use the accommodations within one (1) year of the date the Prize was awarded. Vacation does not include meals, air fare, ground transportation, travel insurance, or any other expenses.
The hotel will be in or near one of the major South Florida cities (e.g., Miami, Hollywood, Fort Lauderdale, Deerfield Beach, Pompano Beach, Boca Raton, Delray Beach, Lake Worth, Boynton Beach, West Palm Beach, Palm Beach, Jupiter) or adjacent towns.
Sponsor will attempt to accommodate Winner’s preferred location, if requested. However, Sponsor will have the final decision and is not obligated in any way to choose a hotel or city requested by the Winner. All accommodations will be determined based on hotel room availability and Prize value limit.
b. Cash Prize Option ($250): Our primary desire is for the sweepstakes winner to visit South Florida. That way we can support our community and gather awesome testimonials. However, we realize that circumstances may prevent a winner from taking the trip.
We certainly don’t want the winner to be left empty handed. For this reason, we will allow the winner to claim the $250 cash prize option. This will apply to any winner who is unable to make the trip or simply chooses not to visit for any reason or no reason.
In this regard, immediately after the sweepstakes entrant is notified that they are a Prize winner, they will be asked if they want the Vacation Prize or the Cash Prize Option. They will have a maximum of fourteen (14) days after the selection date to notify the Sponsor, in writing, as to which Prize they will accept.
Once the fourteen (14) day decision period has ended, the Cash Prize Option will no longer be available at any other time. If the cash is declined during this period, or the winner fails to provide a decision, the winner must accept and abide by the rules pertaining to the Vacation Prize which are outlined in all prior and subsequent sections of this document.
c. Vacation Prize Value: The Prize is currently valued at a maximum of $575.00 USD, which only includes a hotel room, and standard room fees and taxes.
- NOTE: Upon checking-in to the hotel, the Prize Winner may be asked by the hotel to provide a credit card or cash deposit to cover any incidental charges that may arise, such as room service or parking. This will be the responsibility of the Prize Winner.
10. PRIZE RESTRICTIONS
Sponsor reserves the right to offer only the stated number of Prizes by random drawing among all legitimate, un-awarded, eligible Prize claims. No more than one (1) Prize will be offered to an Entrant and only one (1) Prize will be offered per household. Prize Winners will be removed from any further drawings and will not be eligible to receive any further Prizes.
The Vacation Prize Winner(s) must have concluded all their travel within twelve (12) months of receiving their award notification. Winner will forfeit this prize if they fail to conclude their trip within the allowed time period. No substitute prize will be offered. All vacation accommodation bookings are for three (3) nights consecutive days.
Winner must be a member of the traveling party on all occasions.
All accommodations are subject to availability. No refunds, compensation or alternative dates will be offered to the Winner in the event of cancellation of a confirmed reservation by the Winner. Prizes cannot be used in conjunction with any other promotion or offer. Prizes cannot be substituted, assigned, transferred, or redeemed for cash by Winner unless approved by Sponsor.
All members of the Winner’s party must possess valid travel documents, including valid government identification, passport and visa where required. Any and all fees and costs and all applicable federal, state, and local taxes and expenses related to acceptance and use of the Prizes not specifically stated herein, including but not limited to, air travel fees, transportation to and from airport, travel and automobile insurance, passenger tariffs or duties, surcharges, airport fees, service charges or facility charges, security fees, gratuities, food, excursions and/or other expenses, are solely the responsibility of the individual Prize Winner.
Winner’s guest must be of the legal age of majority in his/her jurisdiction of residence, or, if guest is a minor child, guest must be accompanied by his/her parent or legal guardian who shall be one of the people in the Winner’s party. The minor must stay with the parent or legal guardian in the parent’s or legal guardian’s accommodations during the trip.
To the extent permitted by law, guest (or if a minor, his/her parent/legal guardian) must execute a Declaration of Compliance Release prior to issuance of a confirmed accommodation booking.
In the event Winner and/or guest engages in behavior which (as determined by Sponsor in its sole discretion) is obnoxious, threatening or illegal, or which is intended to threaten or harass any other person, or which in any way disparages or adversely affects the reputation, image, and/or customer goodwill of Sponsor or any of Sponsor’s services, products, trademarks, service marks, or logos, Sponsor reserves the right to terminate the vacation early, and send Winner and/or guest home, and Sponsor shall have no further obligations whatsoever (including any obligation to pay compensation) to the Winner and/or guest in respect of that vacation or any future accommodation and any future reservations will be cancelled.
In the event Winner and/or guest engages in behavior during their vacation that (as determined by Sponsor in its sole discretion) is illegal, tortious, or subjects Winner and/or guest to arrest or detention, Sponsor shall have no obligation to pay any damages, fees, fines, judgments or other costs or expenses of any kind whatsoever incurred by Winner or guest as a result of such conduct.
TO THE EXTENT PERMITTED BY LAW, SPONSOR SHALL HAVE NO LIABILITY FOR ANY PERSONAL INJURIES, DEATH, PROPERTY DAMAGE, LEGAL IMPLICATIONS OR OTHER DAMAGES OR EXPENSES RESULTING FROM OR ARISING OUT OF ANY TRAVEL RELATED TO THE Prize OR ANY OTHER ASPECT OF GRAND/MONTHLY PRIZE WINNER’S OR GUEST’S ACCEPTANCE OR USE OF THE GRAND/MONTHLY PRIZE.
All Prize details are at Sponsor’s sole discretion. Sponsor is required by law to report the Prize where required. An IRS form 1099 or W-8BEN will be issued to the Winner, if appropriate. However, should Sponsor not obtain or provide these documents, in no way does it impact Winner’s responsibility to pay all applicable state and federal taxes for the Prize. Winner should consult with a tax professional.
11. GENERAL CONDITIONS
a. In the event that the operation, security, or administration of the Giveaway is impaired in any way for any reason, including, but not limited to fraud, virus, bug, worm, unauthorized human intervention or other technical problem, or in the event the Giveaway is unable to run as planned for any other reason, as determined by Sponsor in its sole discretion, the Sponsor may, in its sole discretion, either (i) suspend the Giveaway to address the impairment and then resume the Giveaway in a manner that best conforms to the spirit of these Official Rules or (ii) terminate the Giveaway and, in the event of termination, award the Prize at random from among the eligible, non-suspect entries received up to the time of the impairment.
The Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Giveaway or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. This reserved right is in addition to, and not in lieu of, any other rights and remedies available to Sponsor either in equity or at law.
Any attempt by any person to damage the website or undermine the legitimate operation of the Giveaway may be a violation of criminal and civil law, and should such an attempt be made, the Sponsor reserves the right to seek damages (including attorney fees) and any other remedies from such person to the fullest extent permitted by law.
Failure by the Sponsor to enforce any provision of these Official Rules shall not constitute a waiver of that provision.
b. Sponsor, and its affiliated companies, may contact Entrants for marketing purposes by e-mail, landline telephone using an automatic dialer (for which express written consent is provided at the time of entry) or post regarding publications and information relating to its products, offers and services.
Entrants consent to be contacted in such manner by entering to win. No purchase or any good or service is necessary or required to enter or win. Purchase or any good or service marketed to an Entrant will not increase the likelihood of winning. 12. RELEASE AND LIMITATIONS OF LIABILITY
By entering the Giveaway, Entrants agree to release and hold harmless the Sponsor, other companies associated with the Giveaway, each of their respective parents, subsidiaries, affiliates and advertising and promotion agencies, and each of their respective officers, directors, employees, shareholders, representatives, and agents (“The Released Parties) from and against any claim or cause of action arising out of or in connection with entry or participation in the Giveaway or receipt or use of the Prize, including, but not limited to:
(a) any technical errors associated with the Giveaway, including lost, interrupted or unavailable Internet service provider, or other connections, availability or accessibility or miscommunications or failed computer, satelliet, telephone, cellular tower or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties;
(b) unauthorized human intervention in the Giveaway;
(c) mechanical, network, electronic, computer, human, printing or typographical errors;
(d) application downloads;
(e) any other errors or problems in connection with the Giveaway, including, without limitation, errors that may occur in the administration of the Giveaway, the announcement of the Winner, the cancellation or postponement of the event and/or the flyover, if applicable, the incorrect downloading of the application the processing of entries application downloads or in any Giveaway-related materials; or
(f) injury, death, losses or damages of any kind, to persons or property which may be caused, directly or indirectly, in whole or in part, from Entrants participation in Giveaway or acceptance, receipt or misuse of Prize. Sponsor hereby expressly disclaims, and Entrant hereby expressly waives, to the maximum extent not prohibited by applicable law, the right to claim any punitive, consequential or other indirect damages, howsoever caused, and regardless of the legal theory on which such claim may be based.
13. PUBLICITY GRANT
Except where prohibited by law, Winner grants to Sponsor (which grant will be confirmed in writing on request of Sponsor), its parent company and any subsidiary thereof, affiliates, retailers, distributors, advertising and promotion agencies, suppliers, and those acting pursuant to its authority, the right and permission to print, publish, broadcast, and use, worldwide in any media now known or hereafter developed, including but not limited to the world wide web, at any time or times, without limitations, the Winner’s name, portrait, picture, city/town of residence, voice, likeness, opinions and biographical information for advertising, trade, and promotional purposes (including the announcement of his or her name on television or radio broadcast) without additional consideration, compensation, permission, or notification.
14. DISPUTES
Except where prohibited, each Entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Giveaway or any Prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Florida, and submits to the personal jurisdiction of such courts, waiving any and all objection thereto, including without limitation objection based on forum non conveniens.
All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, Entrants rights and obligations, or the rights and obligations of the Sponsor in connection with the Giveaway, shall be governed by, and construed in accordance with, the laws of Florida, without giving effect to any choice of law or conflict of law rules which would cause the application of the laws of any jurisdiction other than Florida.
